Dear Sir/Madam, we wish to inform you that the legislative decree n. 196 of 30 June 2003 (“Code concerning the protection of personal data”) foresees the protection of persons and other subjects as regards the processing of personal data.

It guarantees that personal data is processed in accordance with the basic freedoms, rights and dignity of physical persons, with particular reference to privacy, personal identity and the right to the protection of personal data (art. 2).

In accordance with the stated provisions, said processing will be characterised by the principles of fairness, lawfulness and transparency, as well as the protection of your privacy and rights.

Therefore, in accordance with Art. 13 of the aforesaid Legislative Decree, we provide you with the following information:

Processing involves gathering, recording, organising, storing, processing, modifying, selecting, extracting, comparing, using, circulating, cancelling, distributing, interconnecting and anything else of use for carrying out its services, including the combination of two or more of the above activities.

Your data will be processed in the following manner and for the following purposes:

1. Gathering and storing your personal data with the aim of providing its services, verifying the authenticity and providing the Judicial Authority with the information, upon request;
2. Gathering, storing and processing your personal data for accounting and administrative purposes, including possible communication of commercial invoices by e-mail or fax;
3. Processing your personal data to provide the services contained in the site www.hotellunarossa.it, www.hotellunarossa.com and www.hotellunarossa.eu, only upon request by the Judicial Authority, for tracing the telephone and computer that made the connection to our server;
4. Distributing your data to private individuals or bodies only when expressly agreed;
5. Distributing the free newsletter and advertising and business information related to the Hotel Luna Rossa;
6. Providing free services or services upon payment, which you expressly wish to join;
7. Statistics aimed at monitoring the level of customer satisfaction of the quality of the services provided and the activity carried out for a better understanding of customers’ needs.

In any case, you can choose whether or not to receive messages of an informative and/or commercial nature (for example newsletters) by selecting the appropriate box on the registration form. After the first registration, this choice can be modified at any time upon request.

Your data will mainly be processed by automated and computerised means, and stored on computerised and paper supports and on any other type of suitable support, in keeping with the minimum safety measures in accordance with the technical specifications related to minimum safety measures, Enclosure B of Legislative Decree 196/2003.

Your data will be processed by employees and/or professionals appointed by the Hotel Luna Rossa carrying out the aforesaid activities under the direct supervision and responsibility of the Hotel Luna Rossa.

We only request information needed to provide the service. The giving of the data is optional; however refusal of points 1) and 2) makes it impossible to register with our hotel and for the Hotel Luna Rossa to complete your request.

Refusal of point 3) makes it impossible to offer the services in our site, such as booking through the site, etc… however it does not invalidate the Hotel Luna Rossa’s institutional service.

However, refused consent to the above points 4), 5) 6) and 7) will not have any negative effect on registration and the Hotel Luna Rossa will process your data solely for the purposes stated in the previous points.

Moreover, we inform you that, in accordance with what is provided by art. 7 (Right of access to personal data and other rights) of the Legislative Decree 196/2003, in relation to the processing of personal data, each person concerned has the right to:

1. The person concerned has the right to obtain confirmation of the existence or non existence of personal data regarding him/her, even if not yet recorded, and communication of said data in intelligible form.

2. The person concerned has the right to information regarding:
a) the origin of the personal data;
b) the purposes and methods of the processing;
c) the logic applied in the case of processing  by electronic means;
d) the identification details of the holder, of those in charge and of the representative appointed, in accordance with article 5, paragraph 2;
e) the subjects or categories of subjects to whom the personal data may have been communicated, or who may gain knowledge, as representative appointed in the territory of the State, persons in charge or appointees.

3. The person concerned has the right to:
a) update, correct or, when there is an interest, supplement the data;
b) cancel, change into anonymous form or block data processed in violation of the law, including data the conservation of which is unnecessary for the purposes for which the data has been gathered or subsequently processed;
c) receive a declaration that the operations stated in letters a) and b), including their contents, have been brought to the attention of those to whom the data was communicated or circulated, except when this undertaking proves impossible or involves the use of means, which are clearly disproportionate in relation to the right protected.

4. The person concerned has the right, wholly or in part, to oppose:
a) the processing of personal data concerning him/her, for legitimate reasons, even though relevant to the purpose for which it was gathered;
b) the processing of personal data concerning him/her for the purposes of sending publicity material, direct sales or for carrying out market research or commercial announcements.

In order to exercise the rights foreseen by art. 7 of the Legislative Decree 196/2003 and above, the person concerned must make a written request to: Hotel Luna Rossa, Via G. Pica, Napoli.
